BY ACCEPTANCE OR USE OF D&PL SEED, BUYER AGREES THAT SELLER'S LIABILITY AND BUYER'S EXCLUSIVE REMEDY FOR BREACH OF ANY WARRANTY SHALL BE LIMITED TO RETURN FOR THE PURCHASE PRICE OF THE SEED INVOLVED IN THE CLAIM AND THAT CONSEQUENTIAL AND INCIDENTAL DAMAGES SHALL NOT BE RECOVERABLE. Claims for defects in seed contained herein must be presented to SELLER in the manner and within the time prescribed by statutes on seed claims or, if no time is prescribed by an applicable statue, within a reasonable time after discovery sufficient to permit SELLER to inspect the growing crop in the field. As used on this reminder, the term "SELLER" means D&PL and any distributor or other intermediate vendor, and the term "BUYER" means any direct or remote purchaser.
